ٱلْحَمْدُ لِلَّهِ رَبِّ ٱلْعَالَمِينَ وَٱلصَّلَاةُ وَٱلسَّلَامُ عَلَىٰ أَشْرَفِ ٱلْأَنْبِيَاءِ وَٱلْمُرْسَلِينَ وَعَلَىٰ آلِهِ وَصَحْبِهِ أَجْمَعِينَ ط اَمَّا بَعْدُ

سوال:
لڑکی کی مشکوک لاش ملنے پر کیسے معلوم کیا جائے کہ متوفی مسلمان ہے یا غیر مسلم؟
اگر کسی نامعلوم لڑکی کی لاش ملے اور یہ معلوم نہ ہو کہ وہ مسلمان ہے یا غیر مسلم، تو اس کے مسلمان یا غیر مسلم ہونے کی علامات اور جائے وقوعہ کو دیکھا جائے گا۔
بہارِ شریعت میں ہے:
"مُردہ مِلا اور یہ نہیں معلوم کہ مسلمان ہے یا کافر تو اگر اس کی وضع قطع مسلمانوں کی ہو یا کوئی علامت ایسی ہو، جس سے مسلمان ہونا ثابت ہوتا ہے یا مسلمانوں کے محلّہ میں ملا تو غسل دیں اور نماز پڑھیں ورنہ نہیں۔"
(بہارِ شریعت، جلد اول، حصہ چہارم، کتاب الجنائز، مسئلہ 24)
لہٰذا اگر نامعلوم لڑکی کی وضع قطع مسلمانوں جیسی ہو، مسلمان ہونے کی کوئی معتبر علامت موجود ہو، یا وہ مسلمانوں کے محلے میں ملی ہو تو اسے مسلمان کے حکم میں رکھا جائے گا، اس کا غسل دیا جائے گا اور نمازِ جنازہ پڑھی جائے گی۔
اور اگر مسلمان ہونے کی کوئی علامت نہ ہو اور مسلمانوں کے محلے میں بھی نہ ملی ہو تو مسلمان میت کے احکام جاری نہیں کیے جائیں گے۔
اہم وضاحت:
البتہ کسی حقیقی واقعے میں اگر معاملہ مشتبہ ہو تو مکمل حالات اور موجود علامات کسی مستند مفتی اہلِ سنت کے سامنے رکھ کر شرعی حکم معلوم کیا جائے۔
خلاصہ
نامعلوم لاش کے مسلمان یا غیر مسلم ہونے کا فیصلہ اس کی وضع قطع، مسلمان ہونے کی معتبر علامت یا جائے وقوعہ کے قرائن سے کیا جائے گا۔ اگر مسلمانوں کی علامت ہو یا مسلمانوں کے محلے میں ملی ہو تو مسلمان میت کے احکام جاری ہوں گے، ورنہ نہیں۔ حقیقی اور مشتبہ معاملے میں مستند مفتیِ اہلِ سنت سے شرعی حکم معلوم کیا جائے۔

Sawal:
Ladki ki mushtaba lash milne par kaise maloom kiya jaye ke mutawaffa Musalman hai ya ghair Muslim?
Agar kisi namaloom ladki ki lash mile aur yeh maloom na ho ke woh Musalman hai ya ghair Muslim, to us ke Musalman ya ghair Muslim hone ki alamat aur jaye waqoo ko dekha jayega.
Bahar-e-Shariat mein hai:
"Murda mila aur yeh nahi maloom ke Musalman hai ya kafir to agar us ki waza qata Musalmanon ki ho ya koi alamat aisi ho, jis se Musalman hona sabit hota hai ya Musalmanon ke muhalla mein mila to ghusl dein aur namaz padhein warna nahi."
(Bahar-e-Shariat, Jild Awwal, Hissa Chahaarum, Kitab-ul-Janaiz, Mas'ala 24)
Lehaza agar namaloom ladki ki waza qata Musalmanon jaisi ho, Musalman hone ki koi mo'tabar alamat mojood ho, ya woh Musalmanon ke muhalla mein mili ho to use Musalman ke hukm mein rakha jayega, us ka ghusl diya jayega aur namaz-e-janaza padhi jayegi.
Aur agar Musalman hone ki koi alamat na ho aur Musalmanon ke muhalla mein bhi na mili ho to Musalman mayyat ke ahkam jari nahi kiye jayenge.
Ahm Wazahat:
Albatta kisi haqeeqi waqie mein agar maamla mushtaba ho to mukammal halaat aur mojood alamat kisi mustanad Mufti-e-Ahle-Sunnat ke samne rakh kar shar'i hukm maloom kiya jaye.
Khulasa
Namaloom lash ke Musalman ya ghair Muslim hone ka faisla us ki waza qata, Musalman hone ki mo'tabar alamat ya jaye waqoo ke qarain se kiya jayega. Agar Musalmanon ki alamat ho ya Musalmanon ke muhalla mein mili ho to Musalman mayyat ke ahkam jari honge, warna nahi. Haqeeqi aur mushtaba maamle mein mustanad Mufti-e-Ahle-Sunnat se shar'i hukm maloom kiya jaye.

Question:
How can it be determined whether an unidentified girl's dead body is Muslim or non-Muslim?
If the dead body of an unidentified girl is found and it is not known whether she was Muslim or non-Muslim, her appearance, identifying signs and the place where she was found will be considered.
Bahar-e-Shariat states:
"If a dead body is found and it is not known whether the person was Muslim or a non-Muslim, then if the person's appearance is like that of Muslims, or there is a sign establishing that the person was Muslim, or the body is found in a Muslim locality, the body should be given Ghusl and the funeral prayer should be performed; otherwise, not."
(Bahar-e-Shariat, Volume 1, Part 4, Kitab al-Jana'iz, Mas'ala 24)
Therefore, if the unidentified girl's appearance is like that of a Muslim, there is a reliable indication that she was Muslim, or she was found in a Muslim locality, she will be treated as a Muslim. Ghusl will be given to her and the funeral prayer will be performed.
If there is no indication that she was Muslim and she was not found in a Muslim locality, the rulings applicable to a Muslim deceased will not be applied.
Important Note:
In an actual case, if the matter remains doubtful, the complete circumstances and available indications should be presented to a reliable Sunni Mufti to determine the appropriate Shariah ruling.
Summary
The Muslim or non-Muslim status of an unidentified body is determined through its appearance, reliable indications of Islam, or the circumstances and place where the body was found. If there are Muslim characteristics or the body is found in a Muslim locality, the rulings of a Muslim deceased apply. In doubtful real-life cases, a reliable Sunni Mufti should be consulted.
