نانی کا دودھ پیا تو کیا ماموں کی بیٹی سے شادی ہوسکتی ہے؟
اگر کسی بچے کو اس کی نانی نے شرعی مدتِ رضاعت کے اندر دودھ پلایا ہو اور رضاعت شرعی طور پر ثابت ہوجائے، تو نانی اس بچے کی رضاعی ماں بن جاتی ہیں۔
بچے کو دودھ پلانے کی جائز مدت دو سال ہے۔ تاہم اگر دو سال کے بعد اور ڈھائی سال مکمل ہونے سے پہلے دودھ پلایا جائے تو نکاح کی حرمت بھی ثابت ہوجاتی ہے۔ ڈھائی سال کے بعد دودھ پینے سے رضاعی رشتہ قائم نہیں ہوگا، اگرچہ اس عمر کے بعد دودھ پلانا جائز نہیں۔
لہٰذا اگر نانی نے آپ کو پیدائش کے بعد ڈھائی سال، یعنی تیس ماہ کے اندر دودھ پلایا تھا تو نانی آپ کی رضاعی ماں بن جائیں گی۔ نانی کے بیٹے، یعنی آپ کے ماموں، آپ کے رضاعی بھائی شمار ہوں گے، اور رضاعی بھائی کی بیٹی، یعنی ماموں کی بیٹی، آپ کی رضاعی بھتیجی کے حکم میں ہوگی۔
اس لیے ایسی صورت میں ماموں کی بیٹی سے نکاح کرنا جائز نہیں ہوگا، کیونکہ رضاعت کی وجہ سے وہ آپ کی محرم رشتہ دار بن گئی ہے۔
Agar kisi bachche ko us ki Nani ne sharai muddat-e-razaat ke andar doodh pilaya ho aur raza'at shar'an sabit ho jaye, to Nani us bachche ki Razaai Maa ban jati hain.
Bachche ko doodh pilane ki jaiz muddat do saal hai. Lekin agar do saal ke baad aur dhai saal mukammal hone se pehle doodh pilaya jaye to nikah ki hurmat bhi sabit ho jati hai. Dhai saal ke baad doodh peene se razaai rishta qayam nahi hoga, agarche is umar ke baad doodh pilana jaiz nahi.
Lehaza agar Nani ne aap ko paidaish ke baad dhai saal, yani tees mahine ke andar doodh pilaya tha to Nani aap ki Razaai Maa banengi. Nani ke bete, yani aap ke Mamu, aap ke Razaai Bhai shumaar honge aur Razaai Bhai ki beti, yani Mamu ki beti, aap ki Razaai Bhatiji ke hukm mein hogi.
Is liye aisi surat mein Mamu ki beti se nikah karna jaiz nahi hoga, kyunki raza'at ki wajah se woh aap ki mahram rishtedaar ban gayi hai.
If a child was breastfed by his maternal grandmother during the legally recognized period of breastfeeding and the breastfeeding relationship is established according to Shariah, the maternal grandmother becomes his foster mother.
The permissible period of breastfeeding is two years. However, according to the stated ruling, if breastfeeding takes place after two years but before the completion of two and a half years, the prohibition of marriage through breastfeeding is also established.
Therefore, if the maternal grandmother breastfed the child within thirty months from birth, she becomes his foster mother. Her son, i.e. the child's maternal uncle, becomes his foster brother, and the daughter of that foster brother becomes his foster niece.
Therefore, in such a case, marriage with the maternal uncle's daughter would not be permissible, because she has become a mahram relative through breastfeeding.
